Sex Offender No-Show In Court


Quick action at a fast-food restaurant helped catch a convicted sex offender Thursday night in Sioux Falls.

James Smalley is facing felony charges for allegedly soliciting two girls at the East 10th Street McDonalds.

We’re told customers ran after Smalley after he made sexual comments to the girls. The McDonald’s staff responded by calling police.

The McDonald’s owner issued this statement to KELOLAND News:  “The safety and well-being of our customers is a top priority. The police are investigating this matter and we are assisting them in any way possible.”

Police say the girls did exactly the right thing by notifying adults about the incident right away.

Smalley, who’s being held in the Minnehaha County Jail, was scheduled to appear in court Friday, but he refused to go before the judge. That’s a legal maneuver that the Minnehaha County State’s Attorney’s office says is not unheard of.  

Smalley is charged with soliciting a minor and simple assault.

According to the South Dakota Sex Offender Registry, Smalley was convicted of molesting a 16-year-old girl in California, back in 2005.
