Registered Sex Offender Charged With Soliciting Minors

A registered sex offender has been charged with soliciting two minors inside a Sioux Falls fast food restaurant.

At around 8:46 p.m. Thursday, police were called to a restaurant near East 10th Street and South Fairfax Avenue. A 13-year-old girl and her 12-year-old friend told others inside the business that a man made sexual remarks towards them before he left.

People from inside the restaurant were able to chase 46-year-old James Randal Smalley to a business along 8th Street. He was arrested by Sioux Falls Police and charged with soliciting a minor, threatening to commit a sexual offense and simple assault.

Lt. Michael Colwill commented that the two girls did exactly what police want children to do when someone makes them uncomfortable.

“They got ahold of some adults and were able to share what happened,” Colwill said. “The adults were able to take action and get law enforcement involved.”

According to the South Dakota Sex Offender Registry, Smalley was convicted in 2005 for molesting a 16-year-old girl in California.
