Judge Rules All Of IM 22 Should Not Take Effect

A South Dakota judge has ordered that Initiated Measure 22 should not take effect. 

The goal of the measure passed by voters was to update campaign finance laws and create an ethics commission.

Earlier in the month, Judge Mark Barnett put a temporary stop to the law at the request of several Republican lawmakers.  South Dakota Attorney General Marty Jackley then asked the court to re-instate parts of the law.

Barnett has ruled there is no severability.

“The Court further determined it would not be appropriate to leave only part of the Initiated Measure in effect since it was a comprehensive package.  As Attorney General, I will continue to work with the attorneys for the Plaintiffs and sponsors to determine appropriate future action in the litigation,” Jackley wrote in a statement.
