GEAR UP Trial Underway In Sioux Falls

SIOUX FALLS, S.D. - Jury selection began on Wednesday for Stacy Phelps. 

Phelps is accused of backdating contracts with an educational cooperative to avoid a potential audit and hide his alleged inappropriate spending at the organization.  Phelps is the second and final defendant to head to trial in the GEAR UP case. 

Phelps' lawyer, Dana Hanna, says the evidence will prove Phelps didn't defraud or cheat anyone.

Last week, former Mid-Central Educational Cooperative Director Dan Guericke pleaded guilty to one count of falsification of evidence.  Other charges were dropped.

As part of a plea deal, Guericke agreed to cooperate with the state.  That means we could see him testify against Phelps this week. 

The trial comes more than three years after Mid Central's chief financial officer, Scott Westerhuis, shot his wife and family and then killed himself in September 2015.
