Ballots are printed and absentee voting is underway.
But, two Constitution party candidates are still fighting to get on South Dakota’s November ballot.
Late last month, Lora Hubbel and Matt Johnson filed a lawsuit against Secretary of State Shantel Krebs.
They claim South Dakota’s Republican Party meddled in the process. They say it’s unconstitutional for Krebs to leave their names off the ballot.
Late last week the state responded and asked that the lawsuit be dismissed. That didn’t happen.
The judge scheduled a hearing for Thursday.
