Assault Rifle Used In Shooting Death Near Marty
MARTY, SD -

A member of the Yankton Sioux Tribe is in custody for allegedly shooting his uncle and cousin with an assault rifle early Tuesday morning.

Dancing Bull Fischer, 23, is facing one count of second-degree murder for the shooting that happened just before 1 a.m. Tuesday in a home a few miles north of Marty, South Dakota.

According to court documents, 47-year-old Tony Fischer Senior died from a gunshot wound to the head and his son, Dominic Fischer, was critically wounded.

Tony Fischer's other son tells KELOLAND News that Dancing Bull Fischer is the victim's nephew.

"Pour my heart and my hurt out knowing he's in there and he's not alive anymore," Ann Honomichl said as she sat in her car Tuesday watching authorities investigate the crime scene.

Honomichl says she was Tony Fischer Senior's girlfriend for several years and she mourned his loss Tuesday.

"This morning, my sister called me about six-o-clock and told me what happened and I was just, ‘No, that's not real,’" Honomichl said.

Court documents say there were seven people in the home on the Yankton Sioux Reservation early Tuesday morning and most of them were drinking. Two witnesses who were in a nearby bedroom trying to sleep say they heard Dancing Bull Fischer yelling in the living room about an assault that had taken place and saying, 'They are messing with dad.'

The witnesses then heard four to five gunshots and walked into the living room where they saw Dancing Bull Fischer standing there with an assault rifle as Tony Fischer Senior and Dominic Fischer lay on the floor.

Dancing Bull Fischer then left the house, but authorities caught up with him and arrested him early Tuesday morning.

And while investigators continue to piece together why the shooting happened, Honomichl is trying to come to grips with the loss of a man she once loved.

"I'm asking the Lord why, and I'm not ever going to know why, but I'm asking for strength for his family and sitting here praying," Ann Honomichl said.

Dancing Bull Fischer is scheduled to appear in federal court at 11 a.m. Wednesday.

Dominic Fischer remains at Avera McKennan hospital in critical condition.
