KELO-TV/Argus Leader Poll: Constitutional Amendments
SIOUX FALLS, SD - South Dakota voters will decide on four ballot issues on Election Day. Two of the issues are constitutional amendments.

Constitutional Amendment K would guarantee a right to vote by secret ballot to prevent others from knowing how a person voted. According to the Attorney General’s explanation of the issues, the right would apply to elections of public officers, adoption of initiated or referred measures, and elections to designate or authorize employee representation, such as elections concerning unions. Based on results of the KELO-TV/Argus Leader Campaign 2010 poll, the amendment will pass.

Of the 800 registered voters who took part in the poll, 53 percent said they would vote yes on Constitutional Amendment K. Just 23 percent said they would vote no and 24 are undecided.

Constitutional Amendment L would change the annual distribution amounts made from the cement plant trust fund to the State’s general fund, according to the Attorney General’s explanation. More voters are undecided on how they will vote on this issue than said they support it. Of those who took part in the poll, 35 percent say they are undecided, 27 percent plan to vote yes and 38 percent are against the change.

The poll has a margin of error of plus or minus 3.5 percent.

Constitutional Amendment L on the November ballot would change the distribution amounts from the cement plant trust fund to the State’s general fund. The proposed amendment reduces the current $12 million mandatory annual transfer to $8 million over a four-year period. Then, the mandatory transfer is eliminated and the Legislature may transfer up to 4 percent of the trust fund to the state’s general fund as long as the transfers do not cause the trust fund to fall below its original principal amount.
