Emotional Testimony In Dierks Trial
June 25, 2009, 11:57 AM
A Minnehaha County jury is hearing testimony in the Amy Dierks trial and it's already brought out emotions.
Twenty-nine-year old Dierks is charged with aggravated assault, accused of shaking and injuring six-month-old Henry Johnson at her daycare in November 2007.
Both sides gave opening statements Thursday morning and then Henry's mother, Marissa, took the stand. She became emotional when describing his condition and what happened when her husband picked him up from day care November 12. She says Henry was lethargic so her husband brought him to her work. They then took Henry to acute care, where he started having seizures. He was then rushed to the hospital by ambulance.
She says Henry had been a healthy boy before going to Dierks' day care, but defense attorneys say doctors jumped to conclusions about shaken baby syndrome, contending Baby Henry already had problems with bleeding on the brain.
The trial is expected to last through next week.
