SIOUX FALLS, SD -
Witnesses who took the stand on the third day of the pre-sentencing hearing for Rodney Berget revealed that Berget is not the first one in his family to be charged with murder.
Defense lawyers called three witnesses Wednesday morning.
One of those witnesses talked about Berget's family life and background and said that Berget's brother was executed in Oklahoma for murder in 2000.
Judge Brad Zell is deciding whether Berget should be sentenced to death for killing Correctional Officer Ron Johnson during a failed prison escape last spring.
Berget's attorneys will call one more witness Thursday morning, and then Berget will have the chance to make a statement. That's when the defense plans to make its final argument before giving the case to Judge Zell to decide Berget's fate.
