A judge says prosecutors can introduce a recorded conversation between Alfredo Vargas and his wife when Vargas is tried next week for attempted fetal homicide.
The 36-year-old man is accused of giving his former girlfriend herbs in 2010 to induce an abortion. The woman later delivered a healthy child.
Prosecutors notified the defense last week that they intend to introduce a taped conversation between Vargas and his wife during the trial that begins on Wednesday. A police detective recorded the conversation, without Vargas' knowledge.
Defense attorneys objected on the grounds that it is too close to the trial for the state to notify them that the recording is going to be used against their client.
