The South Dakota Supreme Court has upheld a lower court's decision, allowing the annexation of land into the city which is now slated for a Walmart store.
The appellants are a group of residents near the site calling themselves Save Our Neighborhood. The group has argued that the land annexation was illegal because the city didn't first get Lincoln County's approval.
A circuit court judge had ruled that Sioux Falls officials didn't do anything wrong, and Supreme Court justices affirmed it in a decision released Thursday.
The Sioux Falls City Council rezoned about 40 acres of land from agricultural use to commercial for a Walmart supercenter. Save Our Neighborhood collected signatures to have voters consider the rezoning. In April, residents voted to support the rezoning for the store.
