State To Seek Death Penalty In McVay Case
SIOUX FALLS, SD - Minnehaha County State's Attorney Aaron McGowan will seek the death penalty in the case against 41-year-old James McVay. 

McVay was arrested back in July for the murder of Maybelle Schein. McVay is charged with killing Schein and then stealing her car. Authorities in Madison, Wisconsin, ultimately arrested him after investigators used the On-Star system in Schein's car to track him down.

McVay later told local TV stations in Madison that he was on a cross-country killing spree that would end with the assassination of President Barack Obama.

McGowan filed the paperwork Monday to seek the death penalty in the case because he believes under the law, McVay killed Schein in a vile and inhumane way and he did it in an effort to steal her car.

"My office reviewed those different factors. We found two that we thought were applicable in this case and those are the grounds that we filed the paperwork today," McGowan said Monday.

McVay's next court hearing is December 21.

In a jailhouse interview back in July with a Madison TV station McVay was asked about the possibility of facing the death penalty and he said, "If that's what fate has in store for me, let's do it. Otherwise, I'm coming for Obama."

McVay's next court appearance will be December 21.

This is the first death penalty case the Minnehaha County State's Attorney's Office has been involved in since the Daphne Wright murder case in 2007.
