The State of South Dakota, Harms Oil and M.G. Oil have reached an agreement regarding the labeling of 85-octane gasoline.
Attorney General Marty Jackley says both companies cooperated in the investigation, which found 85-octane had been distributed and sold but that the companies did not receive any unusual profits from it.
Both companies have agreed to pay $25,000 to the state's Department of Public Safety to help pay for a portable octane tester and $3,500 to provide educational materials to retailers. Harms Oil will also pay the Attorney General's office $21,500, which it plans to hand over to the state's general fund.
The companies have also agreed to prove they're complying with the terms of the settlement for two years.
