Beginning Monday, the South Dakota Supreme Court will be in session for three days in Vermillion. In total, the justices will hear nine arguments, two of which deal with DUI offences.
On Monday, the justices will hear arguments on the State of South Dakota vs. Sean Whistler at 9 a.m.
Whistler was pulled over in the Spearfish area and arrested on DUI and possession of marijuana charges. But after a urine test, officials found cocaine in his system too. So, he was also charged and convicted on possession of cocaine.
The jury was told if you have any drug present in your system, that's enough to convict someone of possession under South Dakota law.
But, Whistler and his attorney are challenging this possession charge because cocaine was not present on Whistler or in his vehicle.
