Opponents of a south side Sioux Falls Walmart are taking their case in front of the South Dakota Supreme Court Tuesday.
Save Our Neighborhood is challenging the city council's decision to annex the property into Sioux Falls without prior approval of Lincoln County Commissioners.
The council annexed the land into the city last April but opponents of the proposed store argue that Lincoln County needed to sign off on the move first.
A Sioux Falls judge sided with the city council saying the city didn’t need Lincoln County approval because the landowner voluntarily wanted the land annexed into city limits.
Save Our Neighborhood is now appealing that decision to the South Dakota Supreme Court which will hear the arguments Tuesday in Pierre.
