The South Dakota Supreme Court has ruled in favor of the Hurley dog breeder at the center of a September raid.
Turner county prosecutors filed an appeal in May after the judge ruled the search of Dan Christensen's property, and the seizure of 172 of his dogs, was carried out illegally.
But, in an order filed Monday the Supreme Court denied the appeal. Now prosecutors can't use any evidence collected from the raid during the trial.
