An Oklahoma judge says a settlement has been reached to avoid a punitive damage award in a case that blamed sudden acceleration in a Toyota Camry for a wrongful death.
The jury already found Toyota Motor Corp. liable on Thursday for a fatal crash and awarded $1.5 million compensation to Jean Bookout, the driver injured in the crash, and $1.5 million to the family of Barbara Schwarz, who died.
The jury also decided that Toyota acted with "reckless disregard" for the rights of others.
The terms of the settlement were not disclosed, but it eliminated the need for the jury to consider punitive damages.
Attorneys for the plaintiffs blamed the crash on the Camry's electronics, but Toyota said driver error led to the accident.
