McInnes Family Forgives
SIOUX FALLS, SD - As investigators returned to the scene of a deadly car-bike accident in Sioux Falls this week, the family of 23-year-old James McInnes III is speaking out for the first time. They want the man charged in the crash to receive a harsh punishment, but more importantly, they want people to remember a young father whose life was cut too short.

Family and friends are remembering James McInnes III as a loving father who enjoyed being around others, especially his children: two-year-old Stephanie and one-year-old James IV.

"Absolutely loved his kids, lived for his kids. He's going to be missed.  His kids will never get to know him; they'll never get to see what a beautiful person he was," James' father, Jim McInnes, said. "He did not have hate in his heart; it wasn't in his structure."

"Everybody was his friend.  No matter if they were bad to him, he'd forgive him and move on," James' mother, Wendi McInnes, said.

The McInnes have somehow found that in their hearts too.

"Me and my wife are Christians.  We have to forgive him and we have forgiven him because we know the good Lord will take care of business, but they need to step up and really put this guy behind bars for awhile," Jim said.

Prosecutors are now deciding whether to file new charges against 55-year-old David Kinner. He was charged with driving under the influence of a prescription drug and vehicular battery. Police say Kinner either ran a red light or didn't wait for traffic to clear before making a turn on green.

Police were out at the site again Tuesday, reconstructing the crash; it's a crash the McInnes family calls senseless. 

"It could have been avoided.  I think that's one of the hard things to accept about it.  It shouldn't have happened," Jim said.

Kinner has a long record of speeding and careless driving. The McInnes family says it was only a matter of time before something bad was going to happen.

"You don't learn the first few times because it's considered a misdemeanor.  Then the next time a young dad loses his life over it.  It's crazy; it's senseless," Wendi said.

The McInnes family lost a six-year-old daughter to viral encephalitis in 1989.

There will be a candlelight vigil for James McInnes III Tuesday in the Handyman parking lot at 9 p.m.
