Authorities say he raped a 14-year-old girl near Omaha and then headed for Florida.
Now, officials are looking for 31-year-old Oscar Herrera-Menjivar in South Dakota after he jumped from a transport van at an I-90 gas station near Spencer over the weekend.
The transport van was taking Herrera-Menjivar from Florida to Nebraska after picking up other prisoners in Wyoming.
Court documents say Herrera-Menjivar raped the 14-year-old girl in Bellevue, just outside of Omaha, on May 25. The teen reported the crime May 26.
Following the report, investigators learned that Herrera-Menjivar had left Nebraska and headed for Florida. On June 25, authorities found him near Fort Myers, Florida, and arrested him.
Court documents say Herrera-Menjivar left Omaha on May 31 for Florida, just days after he allegedly raped the teenage girl outside her home.
Documents filed in Sarpy County, Nebraska, say authorities started investigating Herrera-Menjivar the day after the alleged rape.
The mother of the 14-year-old girl reported inappropriate Facebook and text messages her daughter was getting from a man who said his name Tonny Menjivar and who claimed to be 18 years old.
The girl told investigators she had given the man her home address. Authorities determined the 18 year old from Facebook was really 31-year-old Herrera-Menjivar.
The victim said she snuck out of the house when the suspect came over in the early morning and the two started kissing. She says Herrera-Menjivar then pushed her to the ground and raped her.
About two weeks later, investigators found out Herrera-Menjivar went to Miami with a friend's 12-year-old son. The brother of the 12-year-old said he was suspicious of the relationship because Herrera-Menjivar would buy the boy clothes and asked the boy to find 'young girls' for the Omaha man to talk to.
Investigators contacted the 12 year old in Florida, but Herrera-Menjivar refused to return to Nebraska. That's when an Omaha fugitive task force along with U.S. Marshals went to Florida to find him, but now the suspect is on the run again.
If authorities catch up with Herrera-Menjivar and if he is convicted of the crime he’s charged with in Nebraska, he faces a maximum sentence of life in prison.
