The South Dakota Supreme Court has decided a Rapid City judge must retire or undergo probation for misconduct.
Judge A.P Fuller was suspended from court last year, and following a six-month investigation of his conduct, the Judicial Qualifications Commission recommend he be forced to retire or be removed as a judge.
The State Supreme Court Justices heard arguments from both sides in April.
The attorney representing the Judicial Qualifications Commission argued Fuller should be removed after years of questionable activities, such as flipping the bird at an attorney, calling police officers a group of racists and using a derogatory name when discussing a person on trial.
Fuller said he was remorseful for what he had done and wanted to stay on the bench.
