A court hearing is set for 1:30 p.m. Monday over language used on the ballots for the Sioux Falls city election on Tuesday.
The Save Spellerberg group says the ballot incorrectly states an outdoor pool would be completed no later than December 15, 2015. The group says the language on the citizens' petition drive states the outdoor pool would be completed no later than December 31, 2015. While the city has been notified of the discrepancy, it hasn't taken action to correct the date.
The Save Spellerberg group is taking the issue to circuit court. It wants to force the city to admit the ballot error and provide the correct ballot language at the polling sites so voters can make an informed decision.
The citizen group will have an hour to present before Judge Susan Sabers; the city will then have 30 minutes to give its side in the case.
