A Circuit Court Judge has dismissed a former police chief's appeal of his murder conviction.
Ken Huber was the chief of police in Highmore when he shot and killed his wife, Pam, in their bedroom in 2007. He was convicted of first-degree murder in 2008, but the South Dakota Supreme Court overturned the verdict in 2010.
Huber was retried and convicted in May 2011. He was given a life sentence immediately after the jury returned its verdict.
Huber later claimed evidence at the second trial was unfair and his lawyers were ineffective. But Circuit Court Judge John Brown could find no fault with the evidence or the defense counsels' performance.
