Homeowner Reacts To Shindler Ruling
SHINDLER, SD -

Nearly four years after a flood destroyed homes in Shindler, a Sioux Falls Judge ruled that the state of South Dakota is fully responsible because they didn't install proper drainage, causing the flood.

Mark Long and four other plaintiffs filed the suit against the state, claiming the stretch of highway 11 didn't have the proper culverts to handle heavy rainfall.

Long had to abandoned this home after the damage from the flood made it unlivable. He built a new home south of Sioux Falls. He says he's satisfied and relieved by the decision from the judge, but it doesn't bring back his home or his belongings.

“The circuit Court Judge presiding over this case, after hearing the facts, made the only possible decision that would be based on facts and laws, and I see no other decision that she could have made,” Long said.

There can now be a separate trial to determine how much each plaintiff in the suit will be paid.
