Driver To Be Sentenced For Fatal Accident

A Spearfish man pleaded no contest to vehicular homicide in the death of a friend who fell from a vehicle and was run over by a rear tire.
Timothy Berry will be sentenced January 21.
Prosecutors said 18-year-old Billy Sexton III of Spearfish fell from a pickup truck while sitting on the ledge of an open window and leaning out. Berry was the driver in the June 21 accident during a camping trip at Orman Dam.
The 19-year-old Berry pleaded no contest to hit and run and pleaded guilty to driving under the influence.
A no contest plea means the defendant does not admit guilt but will not fight the charge.
