We could soon learn whether 27-year-old Joseph Patterson will face murder charges for the death of a two-year-old boy.
On Friday, Patterson was charged with aggravated battery of an infant. Police arrested him for hurting his girlfriend's toddler while he was babysitting on Wednesday.
The little boy died on Friday.
Prosecutors say Patterson will likely face more serious charges but because of the holiday nothing new was filed Monday.
While this case is garnering national attention because Minnesota Vikings running back Adrian Peterson is the boy's father, the circumstances are not anything new.
South Dakota has seen three cases in the last year where a young child has died and the mother's boyfriend is charged with the crime.
The most recent case happened in March when 24-year-old Jay Barse was arrested on a second-degree murder charge in Watertown for the death of 14-month-old Serenity Sea Boy. Barse was the live-in boyfriend of the child's mother.
There was also a case in December. That's when 24-year-old Manegable Chebea Ally was arrested on murder and manslaughter charges. He's accused of beating his girlfriend's 18-month-old son while he was babysitting the toddler on Christmas Eve at a Sioux Falls apartment.
Back in August of 2012, 24-year-old Edward Berges of Rapid City was arrested for killing his girlfriend's two-year-old daughter while he was babysitting her. Authorities say Berges became frustrated with the little girl and hit her in the head. Berges recently pleaded guilty and is serving a 34-year prison sentence.
