The man accused of shooting his uncle and cousin near Marty made his first court appearance in federal court in Sioux Falls Wednesday morning.
Twenty-three-year-old Dancing Bull Fischer is accused murdering Tony Fischer Senior with an assault rifle at a home near Marty, South Dakota, early Tuesday morning.
He's also accused of critically injuring his cousin, Dominic Fischer.
Authorities say seven people were in the home at the time and most of them were drinking.
Witnesses who were trying to sleep in a nearby room say they heard Dancing Bull Fischer yelling about a physical fight just before they heard gun shots.
When they walked into the living room, Tony and Dominic Fischer were lying on the floor.
In court Wednesday, Dancing Bull Fischer was given a court-appointed attorney. He is still custody.
