A man who has admitted to killing a 75-year-old Sioux Falls woman was expected to face a judge Monday but the court hearing has been rescheduled one week.
James McVay pleaded guilty but mentally ill to killing Maybelle Schein in 2011. But he doesn't believe he should face the death penalty.
McVay was arrested in Wisconsin and told a news reporter there he would kill again and wasn't sorry for his action.
His attorney argues that his guilty plea should prevent the death penalty sentence under South Dakota law.
