SIOUX FALLS, SD -
Testimony in the Rodney Berget pre-sentencing hearing is scheduled to resume for a second day Tuesday morning at the Minnehaha County Courthouse as a judge decides whether Berget should be sentenced to death.
Berget, 49, has pleaded guilty to killing 63-year-old corrections officer Ron Johnson during an attempt to escape from the prison with fellow inmate, Eric Robert. Robert also pleaded guilty and has been sentenced to death.
Judge Bradley Zell will consider the testimony from witnesses and experts called by prosecutors and defense lawyers before deciding Berget's fate. Berget asked that a judge, not a jury, decide whether he should receive life in prison or the death penalty.
A third inmate is charged with providing the items used to kill Johnson.
