YANKTON, SD -
Assistant South Dakota Attorney General Doug Barnett has pleaded guilty to DUI in Yankton County.
A Highway Patrol trooper picked up Barnett at the Lewis and Clark Welcome Center near Yankton on May 20 and found he had been drinking and had an open container in his vehicle. His blood test results showed that he had 0.22 Blood Alcohol Content, which is nearly three times the legal limit.
The open container charge was dropped as part of Wednesday's plea.
Today a judge gave Barnett a $350 fine and five days suspended jail time. His driver's license is also suspended for 30 days and he'll also take part in the 24-7 program for 60 days.
His attorney, Eric Schulte, made a brief statement following the hearing saying Barnett accepts responsibility for what he's done.
Barnett was also suspended without pay from the Attorney General's Office and is participating in the 24-7 program at the request of his employer.
