The state Supreme Court has refused to reinstate a lawsuit that challenged the Union County Commission's decision to rezone land for a proposed $10 billion oil refinery in southeastern South Dakota.
The high court's unanimous ruling upholds a circuit judge's decision that a local resident and a group opposed to the refinery lacked legal standing to pursue their lawsuit against the county commission.
Dallas-based Hyperion Resources wants to build an oil refinery and power plant on land that had been zoned for agriculture. The county rezoned the land to allow construction of the refinery.
