SD House Approves Bill Defining 'Juvenile Sexting'

The South Dakota House has passed a bill that more narrowly defines "juvenile sexting" and separates infractions from those of child pornography.

In the measure, juvenile sexting includes intentionally creating, producing, possessing and distributing through any computer or digital media an image of nude minors. The bill makes the act of juvenile sexting punishable by a Class 1 misdemeanor.

The House's version of the bill clarifies that any minor who receives a sexually explicit picture of another minor and deletes it instead of sending it to someone else under 18 would not be charged.

Rep. Charlie Hoffman says when minors send nude pictures to other minors they can cause "irreparable damage to someone's life."

House lawmakers voted 67-1 Tuesday, sending it back to the Senate for approval of its amendment.
