Panel Passes Bill On Sexting By Minors

A House panel supports an amended bill defining "juvenile sexting" and prohibits it in South Dakota.

The House Judiciary Committee on Monday voted for a measure that separates juvenile texting from child pornography cases.  Sen. Mike Vehle says South Dakota either gives juveniles who send nude photos to other minors "a slap on the wrists" or charges them with distribution of child pornography, neither of which fits the crime. He says registering youths as sex offenders goes too far.  If the measure becomes law, those who violate it could face a Class 1 misdemeanor.

The amended bill clarifies that anyone who didn't solicit the image and deletes the text or email upon receipt wouldn't be charged from the outset.

The measure next goes to the full House.
