State Will Not Seek Fees In School Funding Lawsuit

South Dakota Attorney General Marty Jackley says the state will not seek to collect legal fees from parents who filed an unsuccessful lawsuit challenging the state's system for funding school districts.

The South Dakota Supreme Court earlier this month upheld the constitutionality of the school funding system, rejecting arguments that the current arrangement does not provide enough money to provide students with an adequate education.

A handful of parents were the official plaintiffs in the lawsuit, but about 100 school districts helped pay for the court challenge.

At the trial level, a judge had ordered that the parents pay nearly $60,000 in legal costs.

Jackley says the state will not seek to collect those costs because the money would come from the parents or taxpayers of school districts.
