SD Supreme Court Hears Judicial Misconduct Case

The South Dakota Supreme Court is holding a hearing to decide whether Circuit Judge A.P. "Pete" Fuller of Rapid City should be removed from the bench.

The judge is expected to speak to the high court during Thursday's hearing.

The case marks the first time in the 121-year history of the South Dakota judicial system that a judge has faced removal from the bench by the state Supreme Court.

The Judicial Qualifications Commission recommended that Fuller be removed from office or forced to retire. After a six-month investigation, the commission concluded that Fuller had engaged in a pattern of misconduct that showed disrespect to court personnel, lawyers and people involved in cases.

Fuller has argued that his conduct does not warrant removal from the bench.
