The Fruit Club Responds To Federal Lawsuit

The Fruit Club is responding to a federal lawsuit filed by an Oregon company. 

On Monday, KELOLAND News told you The Fruit Company is suing the Sioux Falls business for more than $70,000.
  
The lawsuit claims the Fruit Club didn't pay for two shipments of cherries in July. 

A spokesperson with the Fruit Club tells us there's more to the story.  She says The Fruit Company, out of Oregon, sent two bad batches of cherries. The Fruit Club couldn't sell the fruit to customers, so the company didn't pay for them.  She says their lawyers have been going back and forth ever since. 

She also told us the Fruit Club filed a complaint with Oregon's Department of Agriculture.  
We've reached out to the Department to see if we could obtain a copy of the complaint, but officials were unable to find one.
