Lincoln County State's Attorney Tom Wollman wants to revoke the $750,000 bond that 28-year-old Joseph Patterson's father paid in full to get him out of jail last fall.
Patterson was indicted for murder and manslaughter in October 2013 for the death of two-year-old Tyrese Ruffin - the biological son of NFL star Adrian Peterson.
On Wednesday, Patterson was arrested on new charges of kidnapping and assault after authorities say he strangled a Sioux Falls woman in a south side Sioux Falls apartment. Patterson is being held on a $1 million cash-only bond in Minnehaha County for his new charges.

Patterson is also being held on a separate $1 million cash-only bond in Lincoln County while a judge decides whether the $750,000 bond Patterson's father already paid in full should be revoked and forfeited.
"The $750,000 that was previously posted at this point in time will be the focus of my motion that was filed yesterday," Lincoln County State's Attorney Tom Wollman said Thursday.
Wollman says that $750,000 should be given up because Patterson is accused of violating the terms of his release with his arrest this week.
"There's a condition of good behavior that's implied in all conditional releases and it is our allegation that is contained in our motion that based upon his arrest for aggravated kidnapping and aggravated assault that he violated those terms," Wollman said.
A brief hearing was held Thursday in Lincoln County, but Patterson's attorney, Tim Rensch, asked for a new hearing because he does not have a copy of the motion yet. The next hearing will be held on July 10.
If the judge rules that Patterson's new charges do violate conditions of his release, the $750,000 already paid will likely go to Lincoln County.
"Ultimately that money finds its way back through to the county," Wollman said.
