A South Dakota death row inmate wants a new sentencing hearing.
Attorneys for Rodney Berget went in front of the South Dakota Supreme Court to argue why the convicted killer should be resentenced.
Berget is appealing the death penalty after he murdered Correctional Officer Ron Johnson during a failed prison escape in 2011.
Berget’s attorney says that the inmate should be sentenced again because after Berget was sentenced to death, he discovered he has a son and grandchildren.
Berget wants those facts to be considered at a new sentencing hearing.
