Judge: Both Sides In GEAR UP Case Must Share Certain Information

The judge in the GEAR UP criminal cases cleared up a few minor legal issues ahead of the upcoming trials for the defendants on Monday.

During a meeting via telephone, Judge Bruce Anderson ruled that the state must provide Stacy Phelps' defense with information on which audit or investigation his client is accused of trying to avoid.

Phelps, who was head of the American Indian Institute for Innovation, along with former director of Mid Central Education Cooperative Dan Guericke, are both accused of backdating contracts.to avoid an audit. The state says the alleged fraud was included in a 2015 legislative audit of GEAR UP. 

The judge also ruled that both sides must let the other know who their expert witnesses will be and what their overall opinions will be during the trials.

Guericke and Phelps go on trial beginning June 25, 2018.

Meanwhile, Guericke has a new job as administrator of the Aurora-Brule Nursing Home in White Lake. He starts his new position on December 26. 

The case for Stephanie Hubers, former assistant business manager at Mid Central, is scheduled to go on trial March 1, 2018. She is accused of helping the Scott and Nicole Westerhuis hide embezzled money and taking payments for it.
