The man who killed a 75-year-old Sioux Falls woman as part of a cross-country plot to assassinate the President is scheduled to be in court Wednesday.

42-year-old James McVay killed Maybelle Schein in her Sioux Falls home nearly a year-and-a-half ago.

In a jailhouse interview after his capture in Wisconsin, McVay said it was the beginning of his plan to kill President Obama.

He pleaded guilty but mentally ill and now faces the death penalty.

But at a motion's hearing Wednesday his attorneys will argue that he is not eligible for capital punishment because of his plea.
