South Dakota's battle over a smoking ban will make its way into a courtroom Tuesday. Both sides of the issue are gathering in Hughes County.

Both those who support a statewide smoking ban and those against it have filed several motions surrounding the ban and its court proceedings.

The judge is expected to rule on many of those motions, and those rulings could give a better picture on how the ban will play out in court. However, because both sides of the issue are asking for a summary judgment, it is possible that the judge could rule on the smoking ban as early as today.

If an overall ruling isn't made, the smoking ban is scheduled to be back in court on October 26.
